Terms of Business
These Terms of Business apply to the estate planning services provided by Coal & Kin Estate Planning (“we”, “us”, “our”). Before you commit to any service, we will confirm in writing the services, scope, price and any deposit that apply to you.
Our Service
We provide estate planning guidance and arrange for the preparation of documents such as Wills and Lasting Powers of Attorney (LPAs). We aim to provide clear, straightforward advice based on your individual circumstances.
Use of Third-Party Providers
We may partner with trusted third-party providers to assist in the preparation of documentation. We manage the process on your behalf to ensure everything is handled accurately and professionally.
Instructions, Draft Review and Completion
We take your instructions and arrange document preparation. Draft documents, clearly marked as drafts, are sent to you for checking and approval. Please check names, details and wishes carefully and respond within seven calendar days; extensions may be agreed. Final documents are prepared after your approval and are provided in printed form, by post or personal delivery as agreed.
Fees and Payment
Fees and the deposit amount will be agreed before work begins. A deposit is required on instruction. Unless otherwise agreed in writing, the full outstanding balance is due when final documents are ready and must be paid before they are released, subject to your statutory rights. Alternative arrangements are at Coal & Kin’s discretion and must be agreed in writing. Subsequent registration or administration does not defer agreed document-preparation fees; any expressly included services remain our responsibility. Government fees and any additional third-party costs are identified separately.
Additional Work and Costs
If additional work is required beyond what was originally agreed, we will always discuss this with you before proceeding. Where trusts are included, there are typically additional costs in the future to put these in place, depending on your circumstances.
Your Responsibilities
You are responsible for ensuring that all information you provide to us is accurate and complete. We cannot be held responsible for issues arising from incorrect or incomplete information.
Changes and Updates
If your circumstances change, updates to your documents may be required. Additional fees may apply for any future work.
Cancellation
Where our contract with you is made at a distance or away from our business premises, you may have the right to cancel within 14 days. If you ask us to begin work within that period, we may make a fair charge for work already carried out. Nothing in these terms affects your statutory rights.
Liability and Complaints
Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited. If you are unhappy with any aspect of our service, please contact us at info@coalandkinestateplanning.com or on 07870 505076 and we will acknowledge and respond to your complaint as quickly as possible.
